Madonna wins ‘Vogue’ Sampling Lawsuit

A lawsuit claiming that Madonna and producer Robert “Shep” Pettibone illegally sampled a tune on her 1990 international hit “Vogue,” has been resolved with a ruling favor of the defendants.
The original lawsuit was filed in July by VMG Salsoul, the copyright owner of a 1976 composition called “Love Break.” The plaintiff alleged that it was only through new technology that the “deliberately hidden” sampling had been detected.
But a U.S. District Court judge in California has ruled on summary judgment that sampling of the Horn hit was “trivial,” in that in could not be recognized.
“Having listened to the sound recordings of Chicago Bus Stop, Love Break, and Vogue, the Court finds that no reasonable audience would find the sampled portions qualitatively or quantitatively significant in relation to the infringing work, nor would they recognize the appropriation,” the ruling reads. “The Court finds that any sampling of the Horn Hit was de minimis or trivial.”
Says attorney Richard Busch, who represented the defendants: “We are thrilled with the decision, and believe it is absolutely the right result.”

Madonna calls for release of Greenpeace activists

Pop legend Madonna has joined a chorus of international stars in urging the release of 30 Greenpeace crewmembers jailed after a protest against energy prospecting in the Arctic.

“These 30 people are in prison in Russia for staging a peaceful protest in the Arctic! Let your voice be heard. Let’s bring these people home!” Madonna wrote in a message posted by Greenpeace on Twitter late Friday.

She spoke out after former Beatle Paul McCartney on Thursday published a letter to President Vladimir Putin saying he hoped the activists could be home for Christmas.

The following day, Oscar-winning French actress Marion Cotillard climbed into a cage outside the Louvre in Paris to call for the activists’ release, calling their detention “absolutely absurd and crazy.”

The activists from Greenpeace’s Arctic Sunrise icebreaker are awaiting trial in prisons in Saint Petersburg, where they were moved from the far northern city of Murmansk.

German Chancellor Angela Merkel has already voiced concern over their case while British Prime Minister David Cameron last week urged Putin to treat the so called “Arctic 30” fairly.

Russia’s Investigative Committee said last month it was softening the charges against the crewmembers, who come from 19 different countries, from piracy to hooliganism, which carries a maximum sentence of seven years.

But Greenpeace says the piracy charge was never formally lifted.

On November 12, Madonna will conduct a live curation on Tumblr where she will comment on the submissions. The final winner will be announced in early December.

“The Tumblr community is rich with people who are passionate about music, art and social causes.. We’re excited to partner with Madonna on the Art for Freedom project and to see what she can bring out of them,” commented Tumblr’s Nate Auerbach.

Madonna began Art For Freedom in partnership with Vice in September by posting Secretprojectrevolution, a 17 minute film she created with Steven Klein. The film has been projected in over several cities around the world, including most recently Tel Aviv, Jericho and Rio de Janeiro.

Art for Freedom has already received thousands of submissions. October’s submissions were guest curated by Anthony Kiedis along with Madonna. Madonna's Secret project

Stephen Bray talks about unreleased Madonna recordings

Being a massive Madonna fan myself, I feel like I’d be remiss if I didn’t ask you at least one question about your fellow ASCAP member and Queen of Pop.

(Laughs) I said The Color Purple was maybe my favorite experience, but I could just as easily say that those early days – those ten years of working with Madonna – were some of the happiest musical times of my life because I was fortunate enough to have a partner where we finished each other’s musical sentences, and I don’t think I’ve ever gotten along quite as well with any other collaborator in terms of writing.

So are there a lot of unreleased recordings from your days working and writing with her that the public has yet to hear?

There are a couple of note that I can think of: There’s a theme song that we were writing to Desperately Seeking Susan, and I have not heard that particular piece of music other than in the pile of cassettes that I have somewhere. Then I think we have a really cool song “First There’s a Kiss” that never saw the light of day.

And do you think that they’ll ever see the light of day, or maybe get an official release?

I hope so!

Nile Rodgers: “Madonna was one of the most amazing people I ever worked with”

“Madonna was one of the most amazing people I ever worked with in my life. She, and I’ve said this thousand times, she was the single most driven artist I ever met. She knew she was going to be a superstar from the word go. When we heard the song “Like A Virgin”, I thought it was just a mediocre song, compared to the other songs on the album. But she knew…”
